1. Agreement to Terms


By subscribing to Maxwell Sim Racing Membership (“Service”), you agree to these Terms of Service (“Terms”). If you do not agree, you may not access or use our services.


2. Membership and Access

• Membership grants unlimited access to our racing simulators during business hours (12 PM – 10 PM).
• Access is personal and non-transferable. We may request identification to verify membership.
• We reserve the right to refuse service for misuse or violation of these Terms.

3. Billing and Payments

• Memberships are billed on a recurring monthly basis through Stripe.
• Subscriptions automatically renew each month until canceled.
• By providing a valid payment method, you authorize Maxwell Sim Racing to charge all applicable fees and taxes.

4. Price Changes

• Membership fees may change with prior notice.
• Continued use of the Service after a price adjustment constitutes acceptance of the new pricing.

5. Cancellations

• You may cancel anytime through the Customer Portal link provided in your confirmation email.
• Cancellation becomes effective at the end of your current billing cycle.
• No refunds are provided for partial months of service.

6. Refunds

• All payments are final and non-refundable, except in cases of duplicate charges or technical errors.
• Refund requests must be submitted within 7 days of the charge.

7. Service Availability and Modifications

• We may modify, suspend, or discontinue the Service with reasonable notice.
• We are not liable for service interruptions due to events beyond our control (maintenance, outages, force majeure).

8. Assumption of Risk

• Participation in racing simulator sessions is at your own risk.
• Maxwell Sim Racing is not responsible for injuries, discomfort, or damages arising from use of the Service.

9. Limitation of Liability

• Maxwell Sim Racing shall not be liable for indirect, incidental, or consequential damages.
• Total liability for any claim shall not exceed the membership fee paid in the last 3 months.

10. Governing Law

• These Terms are governed by the laws of the State of California, United States.
• Any disputes will be resolved in the courts of Orange County, California.
